TERMS & CONDITIONS

We are not huge fans of endless small print (who is?) but there are some legal requirements that we are obliged to put down in writing for your reference. They are fairly standard and are primarily designed to enhance your shopping experience with norvitefarmandcountry.com. By placing an order with us, you are agreeing to accept these terms and conditions. If you have any queries about our Terms & Conditions, please contact us before placing your order.

1 General

These are the conditions of sale which apply to all contracts made between Norvite Farm & Country ("the Seller", “we”, “us”, “our”), a trading name of Norvite Animal Nutrition Company Limited, a company registered in Scotland no. SC281433 whose registered office and principal place of business is at Wardhouse, Insch, Aberdeenshire, AB52 6YD and any customer ("the Customer", “you”, “your”) and shall apply to the sale of any of the Company's products or services ("the Goods"). 1.1 These Terms and Conditions govern your use of the website accessed through norvitefarmandcountry.com (the "Website") and any orders you place through the Website, or with one of our customer service team over the phone. Please read the Terms and Conditions carefully as they affect your liabilities under law and by using the website you are deemed to accept them. They may be changed at any time and any change will take effect from the time of publication on our Website. Your statutory rights are not affected.

1.2 By using this Website you warrant that you are of full legal age and may lawfully enter into any contract with us.

1.3 All communications from us will be made in the English language. All contracts with us will be deemed to have been made in Scotland and any disputes will be regulated by Scots law and you agree that the Scottish courts will have exclusive jurisdiction to determine any disputes.

1.4 We will respond to all e-mail enquiries as quickly as possible.

1.5 Nothing in these terms and conditions will reduce your statutory rights relating to faulty or mis-described goods.For further information about your statutory rights please contact your Local Authority Trading Standards Department or Citizens Advice Bureau.

1.6 If any of these Terms and Conditions is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms and Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.

1.7 All copyright, trademarks and all other intellectual property rights in all material or content supplied as part of this website shall remain at all times vested in us or our licensors. You are permitted to use the material data and content only for your personal use in placing orders through norvitefarmandcountry.com, and you may not otherwise copy, reproduce, transmit, publish, display, distribute, commercially exploit, use or create derivative works of any material data and content on the norvitefarmandcountry.com website without our prior written permission.

2 Orders

Our Website constitutes an invitation to you to do business with us. Any order submitted by you is your offer to enter into a contract with us. For the avoidance of doubt, a contract shall not be established until the point of dispatch of the Goods, at which time we shall be deemed to have accepted your order.

2.1 Before you submit an order, ensure it is correct. Please take care particular care when inputting or providing your delivery address details as you are responsible for their accuracy. After you have placed and paid for your order, confirmation will be sent to you by e-mail that your order is being processed. We will send you the details of your order and the final price via e-mail. You can find our terms and conditions on our website at all times.

2.2 Great effort is made to ensure that prices listed on our website are correct, however errors may sometimes occur. If we discover that an error in the price of goods that you have ordered has occurred we will contact you as soon as reasonably possible and you will be given the option to pay the correct amount or to cancel your order and be given a full refund. If we cannot contact you using the information provided by you then we will treat the order as cancelled.

2.3 If you order Goods listed as being in stock on the Website but when processed we find that the Goods are currently out of stock, we will contact you as soon as reasonably possible by email or phone. You will be given the option to cancel your order, to select an alternative or to wait until the item returns to stock for it to be dispatched to you. We accept no liability arising from our inability to supply goods due to lack of stock other than returning to you any payments made.

2.4 Your order cannot be accepted before we receive payment for the Goods ordered and the delivery costs. Title to the Goods shall not pass to you until we have received in full all moneys owed by you under this and any other contract and until delivery is effected.

2.5 The prices quoted on our Website are inclusive of VAT but exclude delivery costs.

2.6 The price, availability and specification of any Goods are subject to change without notice prior to our issuing an acceptance of your order but not thereafter.

2.7 All descriptions, images and specifications are published only for illustration and are not binding on us.

2.8 Subject to stock availability, we aim to dispatch within 2 working days of processing the order.

3 Delivery

Our delivery costs are: £3.95 for all Goods up to a total spend of £50. Thereafter delivery is free. Our standard delivery takes up to 5 working days* but we post parcels with Royal Mail Tracked 48 so you can usually expect quicker delivery. Bulkier parcels are dispatched with Evri. If you wish to request next day delivery, this can be arranged at an additional cost of £5, subject to some limitations. Orders for next day delivery must be placed before 11am, Monday to Thursday and are sent by Royal Mail Special Delivery Next Day Guaranteed by 1pm. Please see our delivery information.

3.1 Should you not receive your order, and in accordance with Royal Mail's policies, an item shall be deemed as lost if Royal Mail has not delivered it at the place to which it is addressed by the end of the tenth working day (or the fifth working day for Royal Mail Special Delivery Guaranteed by 1pm®) after its due date of delivery, unless there is evidence to the contrary to demonstrate that the item has not been lost. Working days are Monday to Friday and exclude public holidays. Should your item fail to be delivered within the specified timescale, please contact us to report this and trigger the lost item procedure. If your order is confirmed as lost, it will either be replaced or refunded.

3.2 All risk of loss of or damage to the Goods shall pass to you upon delivery. Where the Goods have been signed for, the risk passes to you once your signature is given. If you believe that the Goods or their parcel are in some way damaged or may have been tampered with, it is your responsibility to refuse to sign for them. In the event of the Goods being damaged in transit/prior to delivery, they should be returned for our inspection immediately – please contact us for assistance before returning them.

4 Click & Collect

We offer a click & collect service for customers located conveniently close to one of our stores. There is no charge for this service. Please ensure that you bring your order confirmation to the store to enable us to identify and release your Goods, together with your ID.

4.1 You will receive an order confirmation with text that suggests your order is available for immediate collection. Please note that this wording is not accurate, being supplied by or website hosts and outwith our control to edit. You will receive an email from us when your order is ready for collection. We will work hard to make this ready as quickly as possible, within our stated opening hours, but please do not go to store to collect your order until we have sent you confirmation that it is ready.

4.2 Should you wish to collect the Goods from a store other than that at which the Goods are located, please check your order confirmation email for details of when the Goods will be available for collection, or speak to our team. We will always aim to transfer Goods within 48 hours, but this may take longer if your order is placed at weekends or peak times.

5. Cancellation, returns and refunds

Our returns procedure is set out here and forms part of our Terms & Conditions.

5.1 The Customer shall inspect the Goods immediately upon receipt and shall notify us by email (shop@norvite.com) or telephone (tel. 01651 872955) within 7 days of delivery if the Goods are damaged or do not comply with any of the Contract. If the Customer fails to do so they shall be deemed to have accepted the Goods.

5.2 Where a claim of defect or damage is made the Goods shall be returned to us within 14 days of notice being served in terms of paragraph 5.1. The Customer shall be entitled to a full refund (including delivery costs) plus any return postal charges if the Goods are in fact defective. Before replacement Goods or a refund can be issued, the Goods must be returned for our inspection.

5.3 If you are a consumer you have the right, in addition to your other rights, to cancel the Contract and receive a refund by informing the Seller in writing or by email within 7 working days of receipt of the Goods. Goods must be returned at your expense within 14 days of the written notice and should be adequately insured during the return journey. You will receive a refund of all monies paid for the Goods (including standard delivery charges, if any) except for return postal charges within 30 days of cancellation, provided the goods are returned in appropriate condition. 5.4 In the unlikely event of the Goods developing a fault outwith our 28 day satisfaction guarantee but still within the manufacturer’s warranty period, please contact us before returning for the Goods for inspection. You have the right to expect your Goods to be of reasonable quality and to last for a reasonable length of time, provided they are cared for properly and used in accordance with the manufacturer’s specification. If upon inspection we find that the Goods have failed to meet this expectation, we will either repair or replace them. We reserve the right to send such Goods to the manufacturer for their assessment as experts, before any decision is made on repair or replacement. It may take up to 30 days to process your return in such circumstances.

5.5 From 1st December 2023, our returns period is extended untl 26th January 2024 to allow additional time for return of gift purchases.

6 Data Protection

As stated in our privacy policy, we respect your privacy. We will hold your personal information carefully and securely and will not sell, rent or transfer it to any third parties.

6.1 Norvite Farm & Country will take all reasonable precautions to ensure that details relating to you, your order and payment are kept secure in accordance with the requirements of the Data Protection Act 1998. Unless we are negligent in exercising these responsibilities then we shall not be held liable for unauthorised access to information supplied by you. Where you supply data relating to other individuals you will be deemed to have obtained their agreement to this information being released to us.

6.2 You acknowledge and agree to be bound by the terms of our privacy policy. Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.

7 Limitation of Liability

7.1 Nothing in these Terms and Conditions will restrict our liability for death or personal injury resulting from our negligence, breach of contract or breach of statutory duty, nor will any of these terms restrict any of your statutory rights. For further information about your statutory rights, contact your local authority Trading Standards Department or Citizen's Advice Bureau.

7.2 We will not be deemed to be in breach of contract or of these Terms and Conditions as a result of any delay in our performance or failure to perform our obligations, if that delay or failure to perform is due to any cause or circumstance beyond our reasonable control including, but not limited to, weather, fire, flood and other acts of God, strikes, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war, breakdown of equipment, road traffic problems.

7.3 Other than as set out in clause 7.1, the maximum liability of Norvite Farm & Country arising out of any order for the supply of Goods to you in contract, misrepresentation, restitution or otherwise, arising in connection with the performance of this contract, shall be limited to the price paid for the Goods. Under no circumstances shall Norvite Farm & Country be liable for any form of indirect or consequential loss, costs or expenses as a result of this agreement or contract.
